Overview
These Terms of Use ("Terms") govern access to the BeThere website, Admin Portal, and student app (together, the "Service"), operated by BeThere, Inc. ("BeThere," "we," "us").
Schools accept these Terms and the Privacy page when they create an Admin Portal account. Students accept these Terms and the Privacy page when they install the student app and enter their school code. There is no separate paper agreement — these Terms, together with the Privacy page, govern all use of the Service.
Who can use the Service
The Admin Portal is for school staff authorized by their school. A staff member with authority to act for the school creates the school's Admin Portal account and accepts these Terms on the school's behalf at that time.
The student app is provided to students under the direction of their school as part of the school's phone-free policy. Students do not create standalone consumer accounts; participation is tied to a school code issued by the school, and students accept these Terms when they install the app and enter that code.
Accounts and access
Staff are responsible for keeping their sign-in credentials confidential and for activity that occurs under their account. Schools are responsible for granting and removing staff access.
BeThere may suspend or disable accounts that appear compromised, misused, or operated in violation of these Terms.
Acceptable use
You agree not to:
- Use the Service to harass, surveil, or harm any individual.
- Attempt to access another school's data, bypass access controls, or interfere with the Service's security or integrity.
- Reverse engineer, scrape, or copy the Service except as permitted by law.
- Use the Service in violation of applicable law or your school's acceptable use policy.
School responsibilities
Schools are responsible for configuring their schedule, campus area, roster, and staff roles; for communicating the phone-free policy to students and families; and for handling family questions about participation, accommodations, and student records.
Schools are the data controller for student information they provide to BeThere. BeThere acts as a service provider to the school for that information.
Privacy and student data
Intellectual property
BeThere, the BeThere name and logo, the Admin Portal, the student app, and all related software, design, and content are owned by BeThere, Inc. and protected by intellectual property laws. Subject to these Terms, schools and authorized users receive a limited, non-exclusive, non-transferable right to use the Service while the school's account is active.
Third-party services
BeThere uses managed infrastructure providers (such as hosting, database, and authentication providers) to operate the Service. BeThere is responsible for selecting and configuring these providers, and limits the data shared with them to what is needed to run the Service.
Service availability and changes
BeThere works to keep the Service reliable during school hours, but does not guarantee uninterrupted availability. We may update, improve, or change features of the Service over time. Material changes that affect a school's use will be communicated to the school.
Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law. BeThere does not warrant that the Service will be error-free or that it will prevent every instance of off-task phone use.
Limitation of liability
To the maximum extent permitted by law, BeThere and its officers, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages arising from use of the Service. BeThere's total liability for any claim relating to the Service is limited to the fees paid by the relevant school to BeThere for the Service in the twelve months before the claim, or one hundred US dollars if no fees were paid.
Termination
A school may end use of the Service at any time from the Admin Portal or by contacting BeThere. BeThere may suspend or end access if these Terms are violated, or if continued use would create a security, legal, or operational risk. On termination, BeThere handles remaining school records in accordance with the deletion practices described in the Privacy page.
Governing law
These Terms are governed by the laws of the State of Utah, USA, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Utah.
Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the effective date below and, where appropriate, notify schools through the Admin Portal or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
